Government Abandons Immediate Unfair Dismissal Policy from Workers’ Rights Bill
The government has chosen to eliminate its primary policy from the workers’ rights bill, substituting the safeguard from wrongful termination from the start of work with a half-year threshold.
Industry Worries Lead to Change in Direction
The decision is a result of the business secretary told companies at a key gathering that he would listen to worries about the consequences of the policy shift on recruitment. A trade union representative remarked: “They have given in and there may be more changes ahead.”
Mutual Understanding Reached
The Trades Union Congress said it was willing to agree to the negotiated settlement, after extended negotiation. “The absolute priority now is to secure these protections – like day one sick pay – on the official legislation so that staff can start benefiting from them from next April,” its general secretary commented.
A worker representative added that there was a view that the six-month threshold was more workable than the less clearly specified 270-day trial phase, which will now be abolished.
Governmental Reaction
However, lawmakers are likely to be unnerved by what is a clear violation of the ruling party’s campaign promise, which had vowed “immediate” safeguards against wrongful termination.
The current business secretary has replaced the earlier office holder, who had overseen the legislation with the vice premier.
On the start of the week, the official committed to ensuring companies would not “be disadvantaged” as a consequence of the amendments, which encompassed a ban on zero-hour contracts and day-one protections for staff against unfair dismissal.
“I will not allow it to become win-lose, [you] favor one group over another, the other loses … This has to be got right,” he stated.
Legislative Progress
A union source indicated that the changes had been approved to allow the bill to move more quickly through the House of Lords, which had considerably hindered the legislation. It will lead to the eligibility term for wrongful termination being shortened from two years to 180 days.
The legislation had initially committed that period would be removed altogether and the administration had proposed a lighter touch evaluation term that firms could use in its place, limited in law to nine months. That will now be removed and the legislation will make it unfeasible for an employee to claim wrongful termination if they have been in role for under half a year.
Labor Compromises
Unions insisted they had achieved agreements, including on costs, but the move is expected to upset progressive parliamentarians who considered the worker protections legislation as one of their main pledges.
The act has been modified on several occasions by opposition peers in the upper house to satisfy major corporate requests. The minister had stated he would do “whatever is necessary” to resolve procedural obstacles to the bill because of the second chamber modifications, before then discussing its application.
“The industry viewpoint, the views of employees who work in business, will be heard when we delve into the details of applying those essential elements of the employment rights bill. And yes, I’m talking about non-guaranteed work agreements and immediate protections,” he commented.
Critic Response
The opposition leader called it “one more shameful backtrack”.
“They talk about stability, but govern in chaos. No business can plan, invest or hire with this amount of instability hanging over them.”
She added the bill still featured provisions that would “damage businesses and be detrimental to economic growth, and the rivals will fight every single one. If the ministry won’t abolish the least favorable aspects of this awful bill, we will. The country cannot foster growth with increasing red tape.”
Government Statement
The responsible agency stated the conclusion was the result of a compromise process. “The government was happy to facilitate these talks and to demonstrate the advantages of working together, and continues dedicated to keep discussing with labor organizations, industry and employers to enhance job quality, assist companies and, vitally, deliver economic expansion and decent work generation,” it commented in a announcement.
